1. Acceptance of Terms

By accessing or using Day Trip Anywhere (daytripanywhere.com), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the service.

Day Trip Anywhere is operated by Day Trip Anywhere LLC, located in Wixom, Michigan, USA (“we,” “us,” or “our”). These Terms constitute a legally binding agreement between you and Day Trip Anywhere LLC.

2. Description of Service

Day Trip Anywhere is a travel discovery platform that helps users find day trip destinations and plan routes based on their interests, budget, and available drive time. The service includes:

• Surprise Me — personalized destination suggestions based on user-selected filters.
• Plan My Route — curated stops along a user-defined route.
• My Trips — the ability to save and revisit destinations and routes.

Destination data is sourced from third-party APIs including Google Maps Platform and TripAdvisor. We do not guarantee the accuracy, completeness, or timeliness of any destination information.

3. Accounts and Registration

You may use certain features of Day Trip Anywhere without creating an account. To save trips across sessions or access premium features, you must register with a valid email address and password.

You agree to:

• Provide accurate and current registration information.
• Keep your password confidential and not share it with others.
• Notify us immediately at support@daytripanywhere.com if you suspect unauthorized access to your account.
• Take responsibility for all activity that occurs under your account.

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

4. Free Tier and Premium Subscription

Free Tier

Free users may perform a limited number of searches per day. Search limits are enforced via browser local storage. We reserve the right to adjust free-tier limits at any time.

Premium Subscription

Premium access is available for $4.99 per month or $29.99 per year. Premium subscribers receive unlimited searches and access to additional features as described on the site.

• Subscriptions are billed monthly and renew automatically unless cancelled.
• Payment is processed by Stripe, Inc. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued.
• We reserve the right to change subscription pricing with 30 days’ advance notice to active subscribers.

Refunds

Subscription fees are generally non-refundable. If you believe you were charged in error, contact us at support@daytripanywhere.com within 14 days of the charge and we will review your request.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to bypass, disable, or circumvent search limits or access controls.
• Scrape, crawl, or systematically extract data from the site without our written permission.
• Transmit any malware, viruses, or harmful code through the service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the service in any way that could damage, disable, or impair our servers or infrastructure.

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

6. Affiliate Links and Third-Party Content

Destination and stop cards on Day Trip Anywhere may contain affiliate links to third-party booking platforms including Booking.com, TripAdvisor, and Viator. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you.

Affiliate links are provided for your convenience. We do not endorse, guarantee, or assume responsibility for any products, services, or content offered by third-party sites. Your interactions with third-party sites are governed by their own terms and privacy policies.

Destination information (names, ratings, photos, descriptions) is sourced from Google Maps Platform and other third-party APIs. We do not guarantee the accuracy of this information and are not responsible for errors or omissions in third-party data.

7. Intellectual Property

The Day Trip Anywhere name, logo, website design, and original content are owned by Day Trip Anywhere LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

Destination photos displayed on the site are sourced from Google Places API and are subject to Google’s terms of use. We do not claim ownership of third-party photos or data.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The service will be uninterrupted, error-free, or secure.
• Destination information (hours, prices, availability, ratings) is accurate or current.
• Drive time and distance estimates are precise — always verify routes before traveling.
• Any destination will be open, accessible, or suitable for your needs when you arrive.

Travel involves inherent risks. Day Trip Anywhere provides suggestions for informational purposes only. You are solely responsible for your travel decisions, safety, and expenses.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DAY TRIP ANYWHERE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $10 USD.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Day Trip Anywhere LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the service at any time, with or without cause, and with or without notice. Grounds for termination include violation of these Terms, fraudulent activity, or extended inactivity.

You may delete your account at any time by contacting support@daytripanywhere.com. Upon deletion, your data will be removed in accordance with our Privacy Policy.

Sections 7, 8, 9, 10, and 12 survive termination of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the service shall be resolved exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to personal jurisdiction in those courts.

For users in the European Union: nothing in these Terms affects your rights under applicable EU consumer protection laws.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be communicated to registered users by email. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
